7. Can you describe some successful cases?
Case #1
A newly married husband and wife arrived in Cancun on their honeymoon. They checked into their five star hotel and that evening decided to stroll around the resort grounds. The top landing of a set of concrete steps that led down towards the beach was covered in water from a nearby foot washing station. As the area was not well lit, they were unaware that the landing was slippery. The wife slipped and tumbled down the stairs and seriously injured her back in the fall.
They were continually ignored by the resort management when they attempted to deal directly with them.
Upon their return to Canada, they contacted Nixon Wenger, and through a mediation process that took place in the United States, they were able to negotiate a very successful settlement with the hotels' insurers.
Case #2
A couple checked into a five star resort in Mexico that mainly consisted of cottage-type accommodation. In order to navigate around the resort, each guest was supplied with a bicycle. The wife was riding her bicycle on a resort path, when a "people mover" clipped her handlebars while passing, essentially striking her from behind. She suffered a severely broken wrist on her dominant hand in the fall.
